Terms of Service

1. Who we are

Cometday ("Cometday", "we", "us") operates the website cometday.com and related services (the "Service"), a platform where people discover, discuss and launch software products. We are based in the Netherlands. You can reach us at hello@cometday.com.

2. Agreeing to these terms

By creating an account or using the Service you agree to these Terms, the Privacy Policy and the Community Guidelines. If you use the Service on behalf of a company, you confirm you may bind that company to these Terms.

3. Accounts

• You must be at least 16 years old to create an account.
• Give accurate information and keep your sign-in details secure. You are responsible for activity on your account.
• One person, one account. Accounts created to manipulate votes or evade a suspension are not allowed.
• Sign-in is provided by our authentication provider, Clerk. Their security measures apply to your credentials.

4. Launching products

• You may only launch products you make or are authorized to represent.
• You are responsible for everything you submit: text, images, links, offers and claims. It must be accurate and must not infringe anyone's rights.
• We may review, edit for formatting, reschedule, decline or remove launches that do not meet the Guidelines or these Terms.

5. Your content and the license you give us

You keep ownership of what you post. You grant Cometday a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt for formatting and distribute your content in connection with operating and promoting the Service, including on social media. This license ends when you delete the content, except where it has been shared by others, is needed for legal reasons, or remains in backups for a limited time.

6. Votes and rankings

Rankings are calculated as described on the About page. We may void votes and adjust rankings to counter manipulation, fraud or abuse. Rankings reflect community activity on the Service and are not an endorsement or a guarantee of quality by Cometday.

7. Listings we add

The Service includes listings we add ourselves: established products added by our editors, and new products launched elsewhere that our editors and the review selected. Their text is written by us from the product's own website; product names, logos, trademarks and images belong to their respective owners and are used to identify their products. These listings do not imply any affiliation or endorsement. Owners can claim a listing, or ask us to change or remove it, by contacting us.

7a. Advertising placements

Makers can book placements (Spotlight, Leaderboard, Category, Launch Week) for whole weeks at the price shown when booking. A placement starts on the chosen start date, or at the first opening after it, and runs for the booked weeks; placements are labeled as Featured or Sponsored and do not change the leaderboard ranking. Payment is made in advance by card through our payment provider, Stripe, which also sends the receipt and invoice. Longer bookings get the discount shown at checkout. A paid booking can be cancelled for a full refund until it starts; once it has started it is not refundable, except where the law requires otherwise or where we fail to show the placement. We may decline or end placements that break these Terms or the Guidelines, refunding any unused weeks. Impression and click counts are provided for information and exclude bots and the advertiser's own visits.

8. Automated drafting and review

When you paste a link on the launch page, the Service reads the public web page at that address to prefill your listing, and may use an AI model to draft text. You are responsible for checking and correcting the result before you submit. Every product is reviewed against the Community Guidelines before it is published; that review is partly automated and may be checked by a person. A product that does not pass is not published, and you are told why.

9. Acceptable use

Do not: break the law; infringe rights; post malware, spam or deceptive content; harass others; scrape the Service in bulk or overload it; probe or bypass security; misrepresent your identity; or manipulate votes, comments or rankings.

10. Reporting and takedowns

Anyone can report content using the report option or by email. If you believe content infringes your intellectual property, send us a notice with your contact details, the content concerned and the basis of your claim. We act on valid notices and may notify the person who posted it.

11. Third-party links and services

Products on Cometday link to websites and services we do not control. Your use of them is governed by their own terms. We are not responsible for their content, availability or practices.

12. Suspension and termination

You can delete your account at any time in Settings. We may suspend or terminate accounts that breach these Terms or the Guidelines, or when required by law. Where reasonable we will tell you why.

13. Availability and changes to the Service

We work to keep Cometday available and secure, but the Service is provided "as is" and "as available". We may change, add or remove features.

14. Liability

To the extent permitted by law, Cometday is not liable for indirect or consequential damages, lost profits, lost data, or damages resulting from products listed on the Service or from content posted by others. Our total liability for any claim relating to the Service is limited to one hundred euros. Nothing in these Terms limits liability that cannot be limited under applicable law, including for intent or gross negligence, or your rights as a consumer.

15. Indemnity

If you launch a product or post content, you agree to indemnify Cometday against third-party claims arising from that product or content, or from your breach of these Terms, to the extent permitted by law.

16. Changes to these Terms

We may update these Terms. For material changes we give notice on the Service or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, without prejudice to mandatory consumer protection rules of your country of residence. EU consumers can also use the European Commission's online dispute resolution platform.
